The United Kingdom has recently implemented significant changes to combat illegal cryptocurrency activities. These measures empower law enforcement agencies to take decisive action against criminals involved in crypto-related offenses.

Let’s delve into the key points of these new seizure laws:

Enhanced Seizure Powers

As of April 26, 2024, UK law enforcement agencies now possess enhanced powers to seize, freeze, and destroy cryptoassets used by criminals. Here’s what you need to know:

  1. No Arrest Required: Previously, police officers needed to make an arrest before seizing crypto from a suspect. However, this requirement has been removed. Now, law enforcement can confiscate assets known to be criminally obtained without the necessity of an arrest. This change is particularly crucial when dealing with sophisticated criminals who may attempt to protect their anonymity or operate from overseas.
  2. Seizing Information: Beyond seizing cryptoassets, law enforcement can also confiscate items that could aid investigations. These include written passwords, memory sticks, or any other relevant information.
  3. Controlled Wallets: Law enforcement officers can transfer illicit cryptoassets into an electronic wallet under their control. By doing so, they prevent criminals from accessing these assets. This measure ensures that seized funds remain out of the hands of wrongdoers.
  4. Destruction of Crypto Assets: In cases where returning a crypto asset to circulation is not in the public interest, UK authorities now have the power to destroy it. Privacy coins, which offer high anonymity, are often used for money laundering. Destroying such assets prevents their re-entry into the financial system.
  5. Victims’ Rights: Victims of crypto-related crimes can apply for the release of funds held in cryptoassets accounts. This provision ensures that victims have a pathway to reclaim their assets.

Balancing Legitimate Use and Security

These changes aim to strike a balance between preventing criminals from exploiting cryptocurrencies while supporting the growth of crypto as a potential economic driver. By empowering law enforcement agencies, the UK government seeks to maintain national security and protect both investors and the public.
